This website is operated by PROTEGE LIMITED, a company registered in Hong Kong (Registration No. 37793961), referred to as (“Protege” “PTG”, “us”, “our” or “we”), under the authorisation of GrabTaxi Holdings Pte Ltd (“Grab”).

Access to and use of this website and the products and services available through this website (collectively, the “Service”) are subject to the following terms, conditions and notices (the “Terms of Use”). By using the Service, you are agreeing to all of the Terms of Use, which, together with the Privacy Policy, may be updated by us from time to time without prior notice. You should check this page and our Privacy Policy regularly to take notice of any change we may have made.

Limitation of Liability

Neither Grab Swag Store nor Protege, nor its associated company, affiliates, subsidiaries or assignees nor each of their respective officers, directors, employees, agents, third-party content providers, designers, contractors, distributors, merchants, sponsors, licensors or the like (collectively, “Associates”) warrant that use of the Service will be uninterrupted or error-free. Neither Grab Swag Store or Protege nor its Associates warrant the accuracy, integrity or completeness of the content provided on the website or the products or services offered for sale on the website. No oral or written information given by Protege or its Associates shall create a warranty.

Under no circumstances shall Grab Swag Store or Protege or its Associates be liable for any direct, indirect, incidental, special or consequential damages that result from your use of, or inability to use, the Service including but not limited to reliance by you on any information obtained from Grab Swag Store that results in mistakes, omissions, interruptions, deletion or corruption of files, viruses, delays in operation or transmission, cancellations of orders, delivery delays, or any failure of performance by Protege or Grab Swag Store of any kind. This Limitation of Liability shall apply in any action, whether in contract or any other claim, even if an authorized representative of the Grab Swag Store or Protégé or its Associates has been advised of or should have knowledge of the possibility of such damages. You hereby acknowledge that this paragraph shall apply to all content, merchandise and services available through Grab Swag Store.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROTEGE AND/OR ITS ASSOCIATES TOTAL LIABILITY IN CONNECTION WITH THE SERVICE OR THE PRODUCT OR THESE TERMS WILL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU TO PROTEGE OR Grab Swag Store UNDER THESE TERMS.

Intellectual Property

Unless otherwise stated, Protege and/or its Associates own the intellectual property rights for all material on Grab Swag Store, including the text, information, graphics, logos, design, layout, downloads, pricing, products and services (“Content)”. All intellectual property rights are reserved. You may access this from Grab Swag Store for your own personal use subjected to restrictions set in these terms and conditions.

Terms of Sale

By placing an order, you are offering to purchase a product on and subject to the following Terms of Use , as amended from time to time. All orders are subject to availability and confirmation of acceptance by us. Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible.

Our Contract

In order to enter into a contract with Protege you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. Protege retains the right to refuse any request made by you.

When you place an order, you will receive an acknowledgement e-mail confirming receipt and acknowledgement of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. All orders are subject to acceptance by us. A contract between us for your order will be formed when we accept your order. Your order is accepted when it has been shipped by us and we have accepted payment from you. If we do not accept your order and we have already accepted payment from you, your payment will be fully refunded. You will receive confirmation from us when we have shipped your order.

Pricing and Availability

Whilst we try and ensure that all details, descriptions and prices which appear on Grab Swag Store are accurate, errors (including processing errors and errors in product availability) may occur. The website may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fill any orders that you may place based on information on Grab Swag Store that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies.

If we discover an error in the price or payment of any goods which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If the order is cancelled and you have already paid for the goods, you will receive a full refund.

The prices on Grab Swag Store exclude delivery costs and excludes customs taxes or duties.

Delivery costs will be charged; such additional charges will be clearly displayed, where applicable, and included in the ‘Total Cost’.

NOTE – IMPORT DUTY AND/OR LOCAL TAX MAY BE PAYABLE ON DELIVERY OF YOUR ORDER. IT’S THE RECIPIENT’S RESPONSIBILITY TO PAY THESE CHARGES. PLEASE FAMILIARISE YOURSELF WITH WHAT THESE CHARGES MAY BE TO AVOID ANY UNPLEASANT SURPRISES

When you place an order on Grab Swag Store, you permit Us to charge the credit card, debit card or other payment method you have chosen for your purchase in the total amount of your order (including any shipping charges and taxes, if applicable).

Except to the extent we are prohibited by law, you agree that our goods must not be used for trade events, reproduction, resale or be purchased through this Service for the purpose of making profits, without our prior written consent.

We may impose purchasing limits on our goods from time to time. We reserve the right to cancel any orders that we have identified, or suspect are in breach of those purchasing limits.

Payment

All products sold in Singapore Dollar (SGD). The Service is only available for the currencies listed from time to time on the ordering pages of the Website. These currencies are subject to change from time to time at Grab Swag Store’s sole discretion.

Payment can be made through various payment methods we have available, such as Visa, MasterCard or online payment methods (GrabPay).

You may use Grabapp to make an online payment using GrabPay. GrabPay payment on this website will be routed through to Singapore GrabPay Wallet.

No cash on delivery (COD) option is available.

Product price and rates shown in SGD on the Website for online orders may differ from the exchange rates offered at by Your card issuer – and any conversion in exchange rate is determined by Your card issuer.

If You wish to place an Order for Products available on Grab Swag Store, You may be asked to supply certain information relevant to Your Order including, without limitation, Your name, Your email, Your phone number, Your credit card number, the expiration date of Your credit card, Your billing address, Your Tax ID, and Your shipping information.

You represent and warrant that: (i) You have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any Order; and that (ii) the information You supply to us is true, correct and complete.

By submitting such information, you grant us the right to provide the information to payment processing third parties (“Payment Merchant”) for purposes of facilitating the completion of Your Order.

Payment cards (credit cards or debit cards) are subject to validation checks and authorization by Your card issuer. If we do not receive the required authorisation, we will not be liable for any delay or non-delivery of Your Order.

All payments are processed through Payment Merchant and the type of credit cards accepted by these payment channels as stated on our Grab Swag Store. When you check out, we will transmit your Card Details to the Payment Merchant, in order to allow them to process the transaction. You agree that the Payment Merchant can transmit information about the transaction to the applicable network for your payment cards and that your transaction will be paid for using the payment card you have selected.

We will not store or collect Your payment card details. That information is provided directly to the Payment Merchant, whose use of Your personal information is governed by their Privacy Policy.

Product Descriptions

In describing the products available to purchase online, Protege attempts to be as accurate as possible. However, Protege does not warrant that product descriptions or other content of any Grab Swag Store are accurate, complete, reliable, current, or error-free.

All product pictures are for illustration purpose only and may differ from actual product. All products, sizes and colours are subject to availability. Offer is based on a first come first served and while stocks last basis only.

Discount Codes

We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, purchases made though Grab Swag Store. The conditions of use relating to any discount code will be specified at the time of issue. Discount codes are not exchangeable for cash.

We may not be able to deliver to all locations. If we do not deliver to your location, you will be sent a notice and you will not be charged for your order.

Any delivery dates or times provided by Protege or Grab Swag Store (or its delivery agent) are estimates only and are not guaranteed. You are responsible to provide true and accurate information during the checkout process, including but not limited to the Shipping Address. We will deliver your Order for Products to the Shipping address you provided in the Grab Swag Store Checkout. If we cannot successfully deliver because you have provided incorrect or incomplete delivery information or you are unavailable to accept the delivery, the package may be returned to us or disposed at our discretion, and no refund will be provided. Any replacement or redelivery may result in subsequent costs and expenses which you shall be liable for.

Delivery starts to countdown from the moment the order is being picked up and processed by the courier company. Order placed after 2pm will required 1 additional business day to process. Weekend and public holidays not included.

Free Shipping

Free shipping option is available for countries we shipped to only.

To enjoy Free shipping, the order subtotal (excluding taxes and shipping) must be SGD150 or above.

Total cart with a subtotal (before shipping is applied) of SGD150 and above will qualify for free standard shipping. The shipping time would take approximately 3 – 7 business days and may go up to 15 business days. Delay may happen due to a compulsory customs clearance procedures for all international packages.

The qualifying order will ship via the most cost-effective shipping service which will be selected at Grab Swag Store discretion.

Free shipping applies to online retail orders placed directly through our website only.

Free shipping cannot be combined with other promo or discount code.

Cancelling items, and changing your shipping address or carrier preferences might affect your order’s eligibility for Free shipping.

You will not eligible for Free shipping on your order if you choose to cancel item(s) resulting in your order subtotal being below SGD150 after the order after payment been made. Our customer care will be in touch and advise on the shipping fee.

We reserve the right to change or discontinue the Free shipping with purchase of SGD150 and above option at any time.

If required, this offer does not include any costs associated with return shipping.

Returns and Exchanges

Goods sold are not refundable or exchangeable due to hygiene reasons.

We DO NOT accept any return and exchange of item for wrong selection, size, colour, model, products not meeting your expectation or that you change your mind due to any reason. If you would like a different size or colour, place a new order.

No cancellation is allowed once the order has been processed or is on delivery.

Damaged, Incorrect or Defective Products – You may return and exchange (of the same product) if the product received is incorrect or damaged and defective during delivery.

If you have received a product as the above conditions, please reach out to our customer care at support-grabswagstore@protegeltd.com (with your Order Number, Invoice Number, Photos) within 3 days from receipt of the product. Once we have verified your request, we will arrange a replacement of the product to be delivered to you at no cost.

Do not remove any security tag or product tag attached to the product. Product must be unused and in its original condition and in its original packaging along with all accessories and free gifts received with it (if any). If security tag or product tag have been removed, we shall consider that the product is used and by default will not qualify under our exchange terms.

Protege does not take title to returned items until the item arrives at our fulfilment centre. At our discretion, a refund or a replacement may be issued without requiring a return. In this situation, Protege does not take title to the returned item.

Risk of Loss

All products purchased from Grab Swag Store are made pursuant to a delivery contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

Prohibited Conduct / Behaviour

You must not:

(a) use the Service in breach of any applicable laws or regulations;

(b) use the Service to harm, abuse, harass, stalk, threaten or otherwise offend others;

(d) upload, post, transmit or otherwise make available any material that:

(i) is not your original work, or which may infringe the intellectual property or other rights of another person;

(ii) is, or could reasonably be expected to be, defamatory, obscene, offensive, threatening, abusive, pornographic, vulgar, profane, indecent or otherwise unlawful, including material that racially or religiously vilifies, incites violence or hatred, or is likely to offend, insult or humiliate others;

(iii) includes an image or personal information of another person unless you have their consent;

(iv) you know or suspect, or should reasonably know or suspect, to be false, misleading or deceptive;

(v) contains large amounts of untargeted, unwanted or repetitive content; or

(vi) contains financial, legal, medical or other professional advices.

Your Account

If you use any Grab Swag Store services, you are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account or password. You must not own, hold or control more than one account. We reserve the right to suspend or cancel your account without prior notice and without giving any reason.

Jurisdiction

These Terms of Use are governed by the laws of Hong Kong. If any provision contained these Terms of Use is or becomes legally ineffective under the general law or by legislation, the ineffective provision will be severed from these Terms of Use which otherwise continues to be valid and operative.

Disputes Resolution

If You have any concern or dispute about Our Service, You agree to first try to resolve the dispute informally by contacting Us.

Events Beyond Reasonable Control

Neither party will be responsible for any delay or failure to comply with these Terms if the delay or failure arises from any cause which is beyond its reasonable control.

No Waiver

If you do not comply with these Terms, and we do not take action right away, this does not mean that we are giving up any rights that we may have (such as taking action in the future) for the breach.
